APPROVAL OF OFFICE HOLDER'S FEES

NOTICE IS HEREBY GIVEN by the Liquidator to the creditors of The Planet Group Limited that a meeting of creditors will be held by correspondence in accordance with Rules 18.16, 15.3 and 15.13 of The Insolvency (England and Wales) Rules 2016 and the Insolvency Act 1986 (as amended).

The purpose of the decision procedure is to consider the following resolutions:

1. For the appointment of a Committee if the creditors so wish and sufficient nominations for membership of the Committee are received. Nominations must be delivered to the Convenor by the date specified for the lodgement of votes/proxies in the notice and can only be accepted if the Convenor is satisfied as to the creditor's eligibility under Rule 17.4.

2. In the event that a committee is not appointed the Liquidator’s fees be approved on a combination of a fixed fee and % of realisation basis for different categories of work, details of which are set out in the Leigh Consultancy Limited Insolvency Assignment Charging and Disbursement Recovery Policy circulated to creditors with this notice

3. The Office Holder be authorised to draw 'Category 2' disbursements, periodically on account at his firm's standard rate as amended from time to time & for the amounts so drawn to be notified to creditors periodically as required together with disbursements.

A creditor's vote by correspondence must be received by no later than 23.59 hours on 3 October 2018 (the 'decision date'). Details of how to cast a vote are included in the correspondence delivered to creditors. If any creditor has not received this correspondence or requires further information please contact the Liquidator using the details below.

In order to be counted a creditor's vote must be accompanied by a proof in respect of the creditor's claim (unless it has already been given). A creditor's vote will be disregarded if their proof in respect of their claim is not received on or before the decision date. A creditor who has opted out from receiving notices may nevertheless vote if the creditor provides a proof of debt in the requisite time frame.
