A Notice of the Joint Administrators’ appointment, in respect of this matter, was filed in Court on 30 June 2017. Following the filing of this document, it was discovered that the Company was registered with the Financial Conduct Authority (“FCA”).

Where a Company is regulated by the FCA, consent for the appointment of the Joint Administrators must be sought prior to the directors filing any appointment documents in Court. This has meant that the appointment process is defective, although in accordance with paragraph 104 of Schedule B1 of the Insolvency Act 1986, any acts of the Joint Administrators during this time are valid, notwithstanding such a defect.

In order to cure this defect, consent was immediately sought from the FCA together with an application to Court for directions. On 7 July 2017 a Court Order was granted which confirms that the Joint Administrators were appointed on 6 July 2017, and any acts made by them in the period 30 June to 6 July remain valid.
