Notice is hereby given, pursuant to P54 Schedule B1 Insolvency Act 1986, as amended, and R3.42, R15.5 and R15.13 of Insolvency (England and Wales) Rules 2016, as amended, that a decision of creditors has been convened as a Virtual Meeting via a telephone conference.

The convener of the meeting is seeking decisions upon the approval of the Joint Administrator’s revised proposals for achieving the purpose of the Administration, and for establishing a Creditor Committee.

In the event that no Creditor Committee is established, the convener will also seek decisions upon amendment to the basis of the Joint Administrator’s remuneration and the Joint Administrator’s discharge from liability under P98 of SchB1 to the Insolvency Act 1986 immediately upon their appointment as Joint Administrator ceasing to have effect.

The decision date: 26/09/2017.

The decision time (based on UK time): 3.00 pm.

How to Access the Virtual Meeting

Details of how to access the virtual meeting are included in the notice delivered to creditors. If any creditor has not received this notice or requires further information please contact the Joint Administrator using the details below.

Proof

In order to participate in the virtual meeting the creditor must have delivered a proof in respect of their claim in accordance with Insolvency (England and Wales) Rules 2016, as amended, failing which a vote by the creditor will be disregarded.

A creditor whose debt is treated as a small debt must still deliver a proof if that creditor wishes to vote. A creditor who has opted out from receiving notices may nevertheless vote if the creditor provides a proof. Proofs may be delivered to c/o Mitchell Charlesworth Centurion House, 129 Deansgate, Manchester M3 3WR by 4pm on the business day preceeding the decision date.

Request of Physical Meeting

Creditors (either alone or collectively) who meet one of the thresholds pursuant to §246ZE Insolvency Act 1986, as amended, may request a physical meeting (within 5 business days of delivery of the notice) to be held to consider the matters.

Proxy

A creditor may appoint a person as a proxy-holder to act as their representative and to speak, vote, abstain or propose resolutions at the meeting. A proxy must be delivered to the convener or chair before it may be used at the meeting.
