This Notice is given under Rule 15.13 of the Insolvency (England and Wales) Rules 2016 (“the Rules”). It is delivered by the Liquidator of the Company and the convener of the decision procedure, Ruben Garcia-Quismondo Pereda, of Quabbala Limited, Warwick House, 65-66 Queen Street, London, EC4R 1EB.

The proposed decision is in respect of the following: That a liquidation committee be established if sufficient nominations are received; That the Liquidator’s fees be fixed by reference to the time given by him his staff in attending to matters arising in the Liquidation, such time to be charged at the hourly charge out rate of the grade of staff undertaking the work at the time it was undertaken; That the Liquidator be authorised to discharge all Category 2 expenses, calculated on the bases detailed in Quabbala Limited’s Summary. The decision date is 23.59 hours on 16 September 2022.

All proofs of debt must be delivered by 23.59 hours on 16 September 2022. All voting forms must be delivered to the convener by 23.59 hours on 16 September 2022.

Creditors who meet one or more of the statutory thresholds listed below may, within 5 business days from the date of the delivery of the Notice to creditors, require a physical meeting to be held to consider the matter. Statutory thresholds to request a meeting: 10% in value of the creditors; 10% in number of the creditors; 10 creditors.

Unless they surrender their security, secured creditors must give particulars of their security, the date when it was given and the estimated value at which it is assessed if they wish to vote.
