Notice is hereby given that on 31 January 2018 a Petition was presented to the Sheriff of Tayside, Central and Fife at Falkirk by William Tasker Cumming for inter alia an Order under the Insolvency Act 1986 to wind up DAVID W. SMITH LIMITED having its Registered Office at 238a Main Street, Larbert, FK5 3JP and to appoint Provisional and Interim Liquidators, in which Petition the Sheriff by Interlocutor dated 31 January 2018 appointed Notice of the Import of the Petition and of the deliverance, and of the particulars specified in the Act of Sederunt to be advertised once in the Edinburgh Gazette and once in the Scottish Daily Mail newspaper; ordained the said David W. Smith Limited and any other persons interested, if they intended to show cause why the prayer of the Petition should not be granted, to lodge Answers thereto in the hands of the sheriff clerk at Falkirk within 8 days after such intimation, service or advertisement, under certification; meantime, being satisfied that the share capital of David W. Smith Limited does not exceed ÂŁ120,000 sterling, nominated and appointed Thomas Campbell MacLennan and Alexander Iain Fraser of FRP Advisory, Apex 3, 95 Haymarket Terrace, Edinburgh EH12 5HD to be provisional liquidators of the Company and authorised them to exercise the powers contained in paragraphs 4 and 5 of Parts II of Schedule 4 to the Insolvency Act 1986 and that until an interim liquidator of the said company or the petition at the instance of William Tasker Cumming, 238a Main Street, Larbert, FK5 3JP, as Director of David W. Smith Limited, a Company under the Companies Acts (Company Number SC027450) and having its Registered Office at 238a Main Street, Stenhousemuir, Larbert, FK5 3JP presently pending in this court for appointment is dismissed; all of which Notice is hereby given.
