Notice is given by Freddy Khalastchi and Jonathan David Bass to the creditors of Dalziel & Vine Ltd that set out below are decisions for your consideration under Paragraph 51 of Schedule B1 of the Insolvency Act 1986. Please complete the voting section below indicating whether you are in favour or against the following decisions: i). That the Administrators' proposals be approved. ii). In the event that a Creditors Committee is not appointed, the Administrators' pre-Administration costs, the details of which are set out in the Administrators' proposals and issued with the notice of the decision procedure, be approved. iii). In the event that a Creditors Committee is not appointed, the Joint Administrators' fees will be charged by reference to the time properly spent by them and their staff in dealing with the matters relating to the Administration, such time to be charged at the hourly charge out rate of the grade of staff undertaking the work at the time the work is undertaken and subject to the fees estimate set out in the Joint Administrators' proposals and issued with the notice of the decision procedure. iv). In the event that a Creditors Committee is not appointed, the Joint Administrators be discharged from liability in respect of any action of theirs as Joint Administrators, immediately upon our appointment ceasing to have effect.

A creditor's vote by correspondence must be received by no later than 23.59 hours on 19 September 2019 (the 'decision date'). Details of how to cast a vote are included in the correspondence delivered to creditors. If any creditor has not received this correspondence or requires further information please contact Joint Administrators using the details below.

In order to be counted a creditor's vote must be accompanied by a proof in respect of the creditor's claim (unless it has already been given). A creditor's vote will be disregarded if their proof in respect of their claim is not received on or before the decision date. A creditor who has opted out from receiving notices may nevertheless vote if the creditor provides a proof of debt in the requisite time frame.
