Notice is hereby given that Russell Downs, Douglas Nigel Rackham and Dan Yoram Schwarzmann (the “Administrators”) of PricewaterhouseCoopers LLP, 7 More London Riverside, London, England, SE1 2RT, who were duly appointed as the special administrators of the Company on 1 March 2018, have applied to the Court for the following relief by application notice dated 8 June 2020:

1. The appointment of the Administrators dated 1 March 2018 shall cease to have effect pursuant to paragraph 79(3)(b) of Schedule B1 to the Insolvency Act 1986, as applied and modified by regulation 15 of The Investment Bank Special Administration Regulations 2011; and

2. Each of the Administrators shall be discharged from liability in respect of any action of his as joint special administrator of the Company, with effect from the date falling 28 days from the date on which their appointments cease to have effect, save for any claim or claims made against them (or any of them) prior to that date, pursuant to paragraph 98(2)(c) of Schedule B1 to the Insolvency Act 1986, as applied and modified by regulation 15 of The Investment Bank Special Administration Regulations 2011.

The above application is scheduled to be heard at the High Court of Justice, The Rolls Building, 7 Fetter Lane, London EC4A 1NL at a one-day hearing in a three-day window between 21 – 23 July 2020. The Administrators intend to request an adjournment of the hearing of the application to a later date (anticipated to be in December 2020, subject to the Court’s listing availability). The application will be heard at the same time, and adjourned to the same date, as a petition to wind-up the Company.
